These Terms of Service (Allgemeine Geschäftsbedingungen) apply to all contracts concluded between Amon Benson, StayLimitless.news, Eislingen, Germany (hereinafter "Provider" or "we") and users of the StayLimitless SaaS platform.
StayLimitless provides a software-as-a-service platform that stores and chunks user-provided text summaries into daily transactional emails.
For the Free Tier, the contract is concluded by registering an account. For the "Limitless" subscription, the contract is concluded when the user clicks the final "Order with obligation to pay" (or similar) button in the Stripe checkout process. Payments are processed in advance via Stripe. Subscriptions automatically renew unless cancelled.
Users can cancel their subscription at any time with immediate effect for the end of the current billing cycle by clicking "Manage current books/Subscription" in their dashboard settings.
Users retain full ownership of all text, notes, and intellectual property they upload to the platform. By uploading content, the user grants the Provider a non-exclusive, revocable license to store, process, and transmit the text strictly for the purpose of providing the daily email service to that specific user.
The Provider attempts to ensure 99% uptime of the SaaS platform on an annual average. Exempt from this are times when the server cannot be reached due to technical or other problems outside the Provider's control (force majeure, third-party network failures, API outages from AI providers).
According to standard German law:
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, StayLimitless SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
The contract is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the user is a consumer, mandatory consumer protection provisions of the country in which they have their habitual residence remain unaffected. For B2B customers, the place of jurisdiction is Eislingen, Germany.
